Wakeel in marriage appointing another person as Wakeel – Islamweb

Assalamu alaykum (peace be upon you). My wedding took place exactly one year ago. My uncle obtained my approval for marriage and afterwards nominated my mum as the Wakeel (marriage commissioner) (agent). One of the witnesses for the marriage was my uncle, who was joined by another uncle. I was completely on board with the marriage and am now the father of a child. In today’s world, however, I learned from a book (Qanooni Shariyat) that the Wakeel has no right to nominate another Wakeel, and that if this occurs, the marriage is considered a “Fazooli marriage,” which is lawful only if both parties approve.

Was that a valid argument or not?

What method should I have used to give consent?

Answer

All honor and glory are due to Allah, the Creator of the universes. According to my testimony, there is no god deserving of worship other than Allah and that Muhammad, salallahu alayhi wa sallam, is His slave and Messenger. This circumstance is problematic from two perspectives if you mean that you nominated your uncle to be your Wakeel while accepting your marriage and he, in turn, appointed your mother to be the Wakeel and she carried out the marriage. In the first instance, the Wakeel appointed a new Wakeel.

  1. The Hanafis, on the other hand, permitted it as long as the original Wakeel was present during the contract session, as well as the Wakeel who had been nominated by him.
  2. Scholars were divided on this issue as well; some believed it was prohibited, while others, like as the Hanafis, believed it was acceptable under certain circumstances.
  3. In light of the fact that the marriage has already taken place, there is no harm in considering it as a legal marriage contract, according to Hanafi doctrine.
  4. Allah is the most knowledgeable.

The meaning of Allaah’s name al-Wakeel – Islam Question & Answer

What is the significance of Allaah’s name al-Wakeel (the Disposer of Affairs), and what does it mean? Allah be praised for his mercies. Al-Wakeelis al-Hafeez (the Preserver), and al-Muheet (the Protector) (the One who encompasses allthings). It has also been speculated that it refers to al-Shaheed (the Witness). ‘He is the Sustainer,’ says the Prophet, “who ensures provision for His servants and defends their interests.” The fact is that He has complete control over all of His operations. He alone owns the abilities of creation and command, and no one else possesses any of these abilities.

This word is translated as al-Kafeel (the Guaranteer), and He is the bestguarantor to provide for us, according to some.

Allah says (interpretation of the meaning): “and they said: ‘Allaah (Alone) is Sufficient for us, and He is the BestDisposer of our affairs.'” The verse [Aal’Imraan 3:173] translates as “He is adequate for us.” Al-Wakeel is an Arabic term that refers to the person who has been entrusted with the management of the affairs of the person who has committed them to him.

When a person places his or her confidence in the Lord, he or she submits to His or her Lordship and therefore becomes a real slave of the Lord or master.

Furthermore, He has complete authority to deal with it and defend the matter entrusted to Him, since He is wise and knows how to deal with it in the most appropriate manner.

Because He is the Best Disposer of Situations, this suggests that His knowledge spans everything and that He has full capacity to handle all affairs with perfect wisdom, as He is the Most Wise Disposer of All Things.

AND THE ANSWER IS . . . Al-Wakeel!

On 14 instances in the Quran, Allah refers to himself as Al-Wakeel, which means “The Trustee,” “The Disposer of Affairs,” and “The Guardian.” Al-Wakeel is the only One who is in control of the affairs of people who are under His care, and He is the only One who has the authority to manage all issues according to His will. He is the One on whom one may rely, for He is the source of all strength!

The Disposer of Affairs, The One to be Relied Upon

Wakeel derives from the rootwaaw-kaaf-laam, which may be translated into three different meanings. The primary definition of the word is to designate or entrust someone or anything with the care or control of that item. The second most important definition is to act as a protector of one’s interests, and the third is to be able to rely on. This root appears 70 times in the Quran, each time in one of four derivations. Tawakkaltu (which means “I place my faith in”) and al-mutawakkileen (which means “the ones who put trust in”) are two examples of these forms.

In the end, Al-Wakeel is the ultimate Trustee, Guardian, and Administrator of all things, and we may put our faith in the fact that Al-Wakeel will offer the correct conclusion for every situation.

However, it strengthened their confidence, and they declared, “Allah is sufficient for us, and He is the finest Disposer of circumstances.” Whatever is in the skies and whatever is on the ground are both in His possession.

Al-Wakeel and Other Names

Allah makes a reference to His might and authority in theayaatin which the nameAl-Wakeelis referred to as “The Almighty.” The nameAl-Wakeel is related in meaning to the namesAl-Haseeb (The Reckoner, The Sufficer) andAl-Qadeer (The All-Powerful); we entrust our affairs to Allah because only He has complete control over all things and is sufficient for us as a provider and reckoner; we entrust our affairs to Allah because only He is sufficient for us as a provider and reckoner.

We have examined the most important aspects of the Islamic way of life, the foundations of the family in Islam, as well as the purposes and functions of the family. An attempt will be made in this final section to provide a succinct explanation of the actual functioning of the institution of the family in Islam, including its structure, principles, and norms.

Marriage and Divorce

Marriage, as a social institution, is fundamentally a contract between two people. Furthermore, because it is a civil contract, it is treated the same as other contracts. Of Islamic law, the legitimacy of a contract is determined by the ability of the parties to enter into it, which consists in possessing a majority (bulugh) as well as discretion. The main elements of a marriage contract are mutual consent and public proclamation of the marriage contract. The law does not require that this contract be entered into in any particular form or that it be performed in any particular religious ceremony, although there are various traditional forms that are prevalent among Muslims in different parts of the world, and it is generally regarded as advisable to adhere to them.

  1. This offer and acceptance can take place directly between the parties, or they can be handled through an intermediary (Wakil).
  2. In most cases, this marriage contract, which is entered into during a family ceremony, is witnessed by at least two people.
  3. Even while this last element (the dower) is an important aspect of the plan, it is not required for the legitimacy of the marriage that the amount of the dower is established in advance.
  4. It being a civil contract, the parties are able to keep their personal rights both against one another and against third parties.
  5. Marriage in Islam is not a transient marriage; rather, it is intended to last for the rest of one’s life.
  6. 52 Prior to ultimate breakup, family arbitration is used to resolve disagreements.
  7. If this doesn’t work, the couple will be forced to seek a divorce of their marriage.
  8. A number of detailed regulations and by-laws have been established in this regard by the Quran and the Sunnah, and these have been codified in the fiqh literature to govern many areas of marriage and family life.
  9. Despite the notion that marriage is essentially a connection between the couples, it really fosters bonds between two families, and sometimes much more than that.
  10. The consent of both the bride and the husband is absolutely necessary, if not absolutely necessary.

What stands out most strongly, however, is that marriage in Muslim culture is not only a private agreement between the husband and wife. As a result, the entire family works together to ensure that it is planned, realized, and achieved. 54

The Way Marriage is Contracted

There is no defined ritual for the union of two people. Generally speaking, it has been emphasized that marriages should take place in public settings. Other members of society should be made aware of this change, preferably in a manner that has been adopted by the society as its standard usage (‘urf) language. It is customary for the Nikah (contract of marriage) to take place during a social event in which members of both families, as well as other friends and relatives, are present. Nikah can be conducted by anybody who wishes to do so.

  1. When they deliver the Nikah speech, they quote passages from the Quran and the Sunnah and encourage the newlyweds to live lives of God-consciousness, purity, mutual love and loyalty, as well as social duty and community service.
  2. Following the Nikah, the bride and groom go into the bridegroom’s home, where they begin this new chapter of their lives together.
  3. The true objective of these meetings and feasts is to turn the occasion into a social function and to make the general public aware of it so that they may take part in it.
  4. “The finest wedding is the one upon which the least amount of effort and cost is lavished,” he stated.
  5. And anyone refuses to accept an invitation to a wedding feast is unquestionably disobeying God and His Messenger.” 55

The Structure of a Muslim Family

The family has a three-tiered organizational structure. The first and most immediate group consists of the husband, the wife, their children, their parents who reside with them, and any servants who may be employed by the family. 56 After that, there is a core group, which includes close relatives who live together or apart, have special claims on one another, move freely within the family, are not married to one another, and do not wear a hijab between them. The core group is comprised of close relatives who have special claims on one another, whether they live together or apart, have special claims upon one another, and who have special claims upon one another (veil).

  1. One of the most important aspects to consider in this regard is that they are considered as Mahram, or individuals with whom marriage is banned.
  2. Consanguinity, affinity, and foster-nursing all play a role in the development of this bond.
  3. (d) the sisters of the father or mother (not their daughter or other descendants).
  4. With a few exceptions, the continuation of the same relationships is prohibited through fosternursing.
  5. This is the true extended family, as well as the center of all connections.

It is clear that they have rights and responsibilities of their own, as evidenced by the fact that a number of them are included in the second and third lines of inheritors. On the next page, a diagram depicts the general organizational structure of the family.

The Position of Man and Woman

An adult male serves as head of household and general supervisor in a family’s internal organizational structure. In reality, the post of head of the extended family is held by the oldest member of the extended family. The majority of a man’s obligations reside outside of the home. The father is responsible for providing financial and material support for the family, as well as for the family’s relationships with the rest of society, the economy, and government policy, and he is also responsible for the demands of internal discipline inside the family.

  1. Even in this case, the oldest woman is considered to be at the center of the family organization, but inside each circle and fold, the relative central position is enjoyed by the woman who is at the heart of the organization.
  2. According to the Quran.
  3. 60 Within the family, this is necessary for good organization and administration to be implemented.
  4. There is a clear delineation of roles and duties.
  5. Both are obligated to carry out their respective responsibilities in a fair and equitable manner.
  6. But this is a result of a certain cultural and legal environment, and it is in no way applicable to the Islamic setting, where equality between men and women as human beings has been divinely recognized and legally protected against discrimination.
  7. 61 Every function is significant in and of itself, and each individual should be evaluated in light of the tasks that have been allocated to him or her.

The Family and Society

The Islamic social structure recognizes the importance of the family. In the eyes of Islam, the society that it seeks to construct is not a sensate, sex-filled civilization. It produces an ideological society characterized by a high degree of moral awareness, a strong devotion to the concept of Khilafah, and a focus on the ultimate goal in every human action and interaction. Its discipline is not an imposed discipline, but rather one that arises from each individual’s dedication to the principles and aspirations of Islam and flows from that commitment.

  • The entire system is designed to work in a way that strengthens and fortifies the family, rather than the opposite.
  • Fornication (Zina) as a practice has been outlawed and rendered a crime punishable by death.
  • As a result, promiscuity in any form is strictly prohibited.
  • Clothing, forms of behavior, principles of contract between the sexes, and a variety of other issues that are either crucial or incidental to the discussion are all addressed in the document.
  • A variety of preventative measures have been implemented to safeguard the family against outside influences that might undermine or corrupt the family’s moral and social atmosphere.
  • Some of these measures are in the nature of moral persuasion, while others are in the nature of legislation.
  • It is important to study and understand Islam’s views on marriage and family in the light of the scheme of life that Islam seeks to construct.

The notion of man and family that Islam provides is in direct contrast with the concept of man and family that is widespread in the Western world at the present time.

We shall not accept the apparently value-neutral method that is being used to shape the life and viewpoint of man in the secular culture of the Western world today.

If the purposes and ideals of life are not established correctly, it will be impossible to prevent the future collapse of this and other institutions.

This is the tragedy of our times.

One of the most difficult tasks that lies ahead is the restoration and rehabilitation of this freedom of choice, as well as its wise and informed use in order to put the human family back together.

Human beings should make decisions for themselves as God’s representatives on the planet.

We will be forced to abdicate our true place in the world unless we change our ways, no matter how great our achievements in science and technology are. This is something that we must all oppose, or at the very least all those who believe in God and the presence of a moral order in the universe.

Conditions for nikah

The Prophet (PBUH) is recorded to have declared, “The nikah is my Sunnah,” which means that being married and executing the nikah is more than simply a legal formality; it is also an essential example of the Prophet’s life and character. This truth does not take away from the significance of the act of marriage, but it does clarify that a person who is unable to marry has not committed a sin in the eyes of the law. The Arabic term ‘nikhun’ literally translates as ‘to gather together and absorb.’ An absolute minimum and fundamental precondition for a couple to get completely involved in one another will be the mutual agreement of both parties to perform the nikah, which is intended to bring them together as lifelong partners for the rest of their lives.

  • The Islamic concept of marriage is a bilateral, legal contract in which both partners agree on each and every term of the agreement, resulting in what has been described as a “tight connection” between them (4:21).
  • It is not a holy rite that would bind individuals to one another in a heavenly relationship.
  • The sheer fact that the lady and the man are asked, at the time of the nikah, if either of them is willing to proceed with the ceremony indicates that the nikah is invalid if neither of them consents to the ceremony.
  • You are not authorized to inherit women by compulsion” (O you who believe!
  • It is used in reference to the pre-Islamic custom of widows receiving their husbands’ property, but it may also allude to the practice of forcing people to marry, which has grown popular in many Muslim communities.
  • As a result, the visitors will be able to observe and participate in the good act that is being conducted.
  • They should be two men or two women who are just, responsible, and Muslim, and who are cognizant of the responsibilities that come with being in a Muslim marriage.
  • Those who adhere to the Hanafi school of thought are permitted to designate a wakil of her choosing by a woman acting on her behalf.

According to contemporary standards, one’s social, financial, and educational position, as well as their age compatibility, might be referred to as one’s “standing.” When a woman has just lost her spouse, whether by death or divorce, she should not be in the prohibited time of iddah, according to Islamic law.

  1. The mehr should ideally be presented to the bride on the first day of the wedding.
  2. For all practical purposes, this looks like a sale, and for all practical purposes, it very well may be.
  3. If she subsequently requests a divorce, she will be required to return this (2:229).
  4. It is also necessary to make public the amount of mehr that has been agreed upon.
  5. There is another requirement of the nikah in Pakistan that is included in a column on the official form, known as the nikahnama, which formerly specified that a woman would be permitted to initiate a divorce if her husband consented to that particular condition.
  6. These circumstances, according to certain qazis, are considered to be in violation of Sharia.

Unwritten conditions of the nikah are also understood to include: the bride and groom must be of marriageable age, there should be no expectation or demand for dowry or jahez from the groom’s family, the husband is responsible for providing for the financial support of his wife, and neither partner has the right to force the other to break off all ties to one’s parent(s).

If the Prophet was required to pay more to the ladies whom he selected to marry, it is apparent that no marriage would be genuine if this did not occur as a condition.

When the husband is on his deathbed or at his burial, the wife is sometimes requested to forgive him for the mehr.
